How ESI Late Payment Penalties Work

When an ESI contribution is paid after its due date, ESIC can charge two separate amounts on top of the arrears itself: interest for every day of delay, and damages as a penalty for defaulting. This tool estimates both, so you know roughly what you owe before ESIC issues its own assessment.

Regulation 31-A Interest

ESIC charges 12% per annum simple interest on the overdue amount, calculated for every day between the date of default (the 15th of the month after the wage month) and the date you actually pay.

Regulation 31C / Section 85B Damages

Damages are a separate penalty levied at ESIC's discretion, using a slab rate based on total delay: 5% p.a. for delays under 2 months, 10% p.a. for 2–4 months, 15% p.a. for 4–6 months, and 25% p.a. for 6 months or more.

Unlike EPF, this slab structure has not been revised — ESI damages still follow the same rates they always have, regardless of when the default occurred.
