How EPF Eligibility Works

Establishment-level coverage

EPF registration becomes mandatory once an establishment employs 20 or more people at any point - this is a point-in-time test, not an average across the year. Reaching 20 even briefly triggers permanent coverage under Section 17(1) of the EPF Act, and dropping back below 20 later does not remove the obligation to stay registered. Below 20 employees, registration is voluntary via a joint declaration under Section 1(4).

Employee-level coverage

Mandatory coverage applies to employees whose basic salary + DA is ₹15,000/month or less at the time of joining. Employees above this threshold who aren't already EPF members are called "excluded employees" - coverage is optional for them, available via a joint declaration with the employer. Employees who are already EPF members (with an active UAN) continue as members regardless of their current salary. International workers are covered with no wage ceiling at all.

The Employees' Provident Funds Scheme, 2026 (notified 29 June 2026) reconfirmed the ₹15,000 wage ceiling, and made it explicit that either the employer or the employee can unilaterally reduce or discontinue voluntary contributions made above that ceiling.
